指報導不實 林益世二審免賠

（中央社記者黃意涵台北24日電）壹傳媒所屬壹週刊不滿前行政院秘書長林益世指其報導不實，提告求償。一審判決壹傳媒敗訴後，高院二審也駁回壹傳媒。

壹週刊去年6月報導，指林益世擔任立委時，協助中鋼下游廠商地勇公司取得爐渣鐵料採購合約，向地勇公司負責人陳啟祥收賄新台幣6300萬元，索賄8300萬元未遂。台北地方法院依公務員假借職務恐嚇得利罪等罪，判處林益世7年4月徒刑，案件目前由台灣高等法院審理。

判決指出，林益世在壹週刊出刊當天，在行政院開記者會否認收賄，批評報導不實，並控告壹週刊妨害名譽；時任委任律師賴素如也在電視政論節目說，「我認為林益世是清白」。

壹傳媒認為，林益世和賴素如扼殺雜誌商譽，侵害名譽，向兩人提起民事訴訟，求償200萬元並要求登報道歉。

台北地院一審認為，林益世抗辯是為了自保、自衛，發表言論；賴素如是代當事人辯護，對可受公評之事發表言論，沒有不法侵權，判決壹週刊敗訴。高院今天駁回壹傳媒上訴，全案還可上訴。1021224
